We incorporated this issue into the product with the ability to switch Vololights into a Stealth Mode. This does away with flashing but still gives an early indication solid light once our first deceleration threshold is reached.
In this way, riders can still get the benefits of indicating a downshift or engine brake, while abiding by a flashing law. What's interesting is many state motorcycle handbooks recommend flashing brake lights for certain riding maneuvers (including downshifts), while having automatic flashing barred in the same jurisdictions. Still scratching our heads there.
