I suspect the hazard lights were to indicate that he was going slowly and doing something—in this case delivering mail. Doesn't absolve him from taking due care; nor should it absolve either the driver or the government from liability for the drivers' negligence.

I could guess that the "click-click-click" of the hazards and the driver's intention to turn left, could've entered his mind that he had his indicator out.
But that still doesn't absolve him from his responsibility to ensure that the road, IN EITHER DIRECTION, is clear before he starts to make his turn.
You could be held more liable if it was a properly-constituted road junction, with signs and road markings, but not under these circumstances.
Just my humble opinion.
What did the following car's occupants have to say about "speed"? Is there a speed limit on this bit of road?

i am still waiting for the police report. speed limit on the straight portion where i attempted my pass was 55 mph ... given that he was going very slow that's probably how fast my pass was. on a naked bike i don't cruising over 60 mph.

there's been some discussion about the total cost of repair and whether it should have totaled the bike.

Gee, makes me wonder what an engine replacement cost is. One bright spot: Tax is only 8.25%.

Plan - Get the 'bike totalled, receive insurance payout, buy the wreck back, have fun repairing it yourself (it's all 'bolt-on' bits). Then sell at a huge profit...!!

If you buy the wreck back insurance may have converted it to a Junk title (aka junking certificate) and those can be fun to get around. Arizona would not touch mine and had to make four trips to California. Ended up with a clean title but with everything on computers you can't hide things like that now. It's OK if you intend to keep the bike, not such a good deal if you intend to flip it. My bike had less damage and was junked.

That's just crazy. That person should be fired and CLEARLY not meant for that road. Also would not doubt they were high on something if they are paying so little attention. Always assume they WILL.

yeah, that's what my brother did with his CB550 (pictured in my avatar) when 2 military school kids stole it and wrecked it when police took chase ... it was never quite the same.
i am waiting to see if the honda dealer we sent it to can do it within this estimate ... or if it indeed gets totaled ... if the latter i will take the money and let it go.
so MY plan, if not totaled, is to either sell the bike or put it up for rental on Riders Share website as a side income and to live vicariously through other's adventures. but i think the asking selling price will be low given that it definitely flunks the inevitable "has it ever been down?" buyer question. the zeroed-out odometer will definitely raise some eyebrows and the mileage discrepancy must be recorded when transferring titles.
on the bright side, i opened the dreaded hospital bill today ... it was about what a monthly sucky individual health insurance premium for me would have been! $852.60. covered by my personal injury coverage. however i expect to get a paramedic ambulance bill and i will have some physical rehab bills coming ...
... oh, and my ortho rehab doc is a hottie!
