Sorry to hear about this!
I know someone who popped over a hill in rural country only to find a postal delivery vehicle in the way....He didn't survive. I'd make sure the front forks aren't bent...That could total it.

The CB I bought from Paul had a LOT less damage to it than your bike and the Iowa insurance company not only totaled it - they junked it.
A shame as it was minor surface damage for the most part (exhaust looked really bad )Good luck with your "adventure" and don't feel too bad if your healing takes just a wee it longer. Keep an eye on the collar bone. Get it patched with a metal insert if it does not heal up straight away. I waited a bit too long.

so one law firm turned down my case ... they turned out to be out of state. however we have some new wrinkles that may be of interest ... the police issued me a ticket while i was out of it on the ground waiting for medical help for "failure to control speed"
i of course was unable to sign the ticket. methinks this speed trap of a town was so used to writing tickets, it was a force of habit:![]() yes, this will be contested. however, it does give me a location, though the cop wrote down SH 289 to the east (Preston Road, where the speed limits suddenly change and generate income) instead of FM 121 which i was on. he was probably working 289 when the call came in. here is an overall aerial view: ![]() and a closer view: ![]() street view, facing west: ![]() and the opposite view, facing east: ![]() i plan on looking over the scene for skidmarks and debris, and interview the homeowner. and stick around with my cameras to see how the mail carrier pulls over to the mailbox. i think the tires with brakes applied lost traction on the grass, fell over on the muffler side, and was stopped by the sign when it impacted the headlight area. and here is a summation i have been submitting to lawyers to fight the ticket, and hopefully generate personal injury case interest: ============================================ I had a motorcycle accident on 7/27/2019 on FM 121 west of Gunter. I suffered a concussion, broken collarbone, bruised and scraped right arm, and strained left wrist. I was transported to Baylor hospital McKinney for treatment and released the next day. I went to Gunter police station the following Wednesday to retrieve my firearm (CHL), which was in the motorcycle luggage box and being held for safekeeping. The accident report was not ready yet. When I got home they called a couple of hours later and said I had a citation that I did not sign and my court appearance was scheduled for 8/5. I knew nothing about this! The officer who arrived at the accident scene did not witness the accident and wrote the ticket while I was unconscious. Due to the concussion my last memory was passing the auto speed shop downtown at 4th and FM 121 heading west. I remember it because I took a photo the previous Sunday of a rusted IH pickup there, I noticed that day they had an old Mercury sedan with slanted roll-down rear window from the 1960s. I thought of taking a photo of it but decided to continue west on FM 121. The Gunter detective I called last weekend said that I was passing a rural mail delivery vehicle, which was probably left hand drive civilian vehicle facing the wrong way on the left side of the road to fill a mailbox from their driver’s window, and when they pulled out back into the right lane as I was approaching and passing this previously stationary vehicle, I was told that I went off into the grass to avoid collision with the mail vehicle, hit a sign and fell on my right side. Judging from my injuries and the motorcycle and helmet damage, I estimate my speed to be low when I impacted the ground. Errors on the ticket include: incorrect incident address -- the officer wrote SH 289 west of Wall Street -- the incident occurred on FM 121 West of Wall Street. The intersection written does not exist. The officer was probably used to writing speeding tickets on SH 289 nearby and put it down out of habit, as Gunter is a known speed trap. There is no known or posted speed indicated on the ticket. I never signed the ticket as I was unconscious or at least in and out with no memory afterward.

SO sorry to hear of this Zbillster, not only the accident which is bad enough, but the persecution afterwards. Get well very soon and beat this prosecution nonsense. Best wishes.

Today I found out what REALLY happened.
Today I went out to the accident site and talked to the landowner. He is not a first-hand witness but he gave me details about the accident scene after it happened. There were two objective witnesses in a car that was following me. They were taking photographs at the accident site as well as was the mail delivery driver. The two witnesses also gave a statement to the police. What happened was the mail delivery driver was driving very slowly with his hazard lights flashing in his civilian car. I had the dotted white line in my lane which gives me permission to pass him when safe to do so. I often see slow drivers with hazards flashing on country roads ... slow-moving farm equipment, lost drivers, etc. Note that on many American cars the hazard lights stop flashing when you apply the brake pedal. So when I came up on the mail delivery driver I don't know if his lights were actually flashing or if he was applying the brakes in preparation for the turn which would cause the hazard lights to stop flashing. It would have been safer if he indicated a left turn. ![]() As I was passing him in the left lane he made a surprising left turn into the driveway. I managed to swerve left around him to avoid a collision and onto the slanted grass of the property. My motorcycle continued on the grass. I applied the brakes but they probably locked up on the slick slanted grass surface. I fell to the right off the motorcycle and the motorcycle continued forward on its side until the headlight area struck a road sign which stopped its progress. The sign broke at the base and fell over. I found several broken pieces of headlight near the base of the sign. People came to my aid and apparently I was sitting upright and seemed okay with minor bleeding on my arm and pain in my shoulder. The property owner offered me some water. But eventually I lay down unconscious. Oh, and I did NOT ride in a helicopter to the hospital ... whew! That would have been very expensive. and not turn indicators for left or right ? . . |
