Ultimately the driver is responsible for safe control of the machine. So hopefully commonsense prevails as the rider discovers the safe-abilities of an older bike, using pre-ride checks.
It would be a drag to blindly hop on a vintage ride that had a not-so-obvious broken frame weld and proceed to do the ton. I reckon we would all try to sort out the risks before a spirited ride.
