 Did the forum die?

There is a scenario on another forum I frequent where a guy just bought a bike and felt that the front brakes needed to be bled, but he couldn't get the air out himself so he enlisted the help of a friend. Said friend said to trade bikes afterwards to test out the brakes and the owner agreed. During the test ride they were lit up by the local PD and the owner, now riding his friends bike, pulled to the curb and stopped while his now ex friend took off like a bat outta hell. While running he eclipsed 100 MPH and ran multiple red lights and stop signs before coming to an abrupt halt at the side of an SUV. The day old property is now in a tow yard totaled and the ex friend is on the hospital with a broken back, two broken ribs and a punctured lung....maybe more as I'm taking this information from memory.
The owner contacted his insurance and they said he is not covered due to the bike being used in a high speed pursuit, even though it was not he who was driving.
In this lawsuit happy culture we live in it has been suggested that not only will the ex friend be sued over this, but the owner will as well due to him allowing the rider to be on the bike in the first place. How ridiculous have we become as a society that we can't own up to our own mistakes and not overdo who we blame for theirs?
It's like accusing a knife or gun manufacturer for the murder or death of someone just because that happened to be the tool used to cause the death.
UGH......I can go on, and on, and on.......I need to stop, or I won't.

First off, the bike owner was given wrong information or he (or you) are misunderstanding the information he was given. If he had insurance for the bike, the damage to it would be covered regardless of who was driving...even if it was without the owner's permission. The damage that the other driver caused may be covered, too, but that depends upon fact of which I am not aware. I will say this, though, I would make the case that the rider did not have permission to ride in the manner in which he did and therefore the owner, and his insurance company, would not be liable for those damages, including those to the SUV and the rider's injuries. Now, keep in mind that what I'm saying is true in Illinois, but some other states have different liability laws. Also, I suppose that some crappy insurance companies may have some exclusion for anyone else who rides the bike, but that would be highly unusual.

Now back to the topic.
