No. Something's wrong. I think the flange is on the wrong side of the mounting point. When I get home I'll send a photo of mine. Unless I'm beaten to the draw (or post).

Ahh, I just realized what it is...
Look closely, you'll see my axle nut is removed, as I'm currently changing tires.
This must have allowed the swingarm to relax outward, and there you have it!
Well, that's what I'm hoping for. I'll know for sure tomorrow morning when I remount the wheel. Thanks for your help fellas!

That's a relief! One of the benefits of a Staintune (besides the obvious) is being able to remove or loosen and then retorque tha axle nut without removing the muffler. Same for the shocka, just need to take the muffler holding bolt out and gently push the Staintune outwards until you can get a spanner on, and then remove, the lower shocka mounting bolt. Something I really couldn't do with the OEM.

On my current bike (the second one I've mounted a Staintune) that lower shock bolt is really close to the muffler but I was checking it at full suspension extension while mounting my Ohlins. I had about an 1/8 inch clearance. So far so good in real world riding since I doubt I'll be riding so hard to full drop the rear end, I hope.
On my first CB wasn't even close.

Well, it turns out that my "swingarm flex" theory is not the cause of this issue, so I'm stumped.
The wheel is remounted, and the swingarm didn't close even the slightest bit (I was a bit skeptical that the rebound could be that far anyway...half an inch?)
The bike has never been dropped or bumped on that side, so I'll have to examine the mounting points for the step bracket. It could just be a manufacturing variance from Staintune.
There's got to be several other owners on here....anyone else??

I would doubt that it is manufacturing variance. It's difficult to tell what the problem might be purely from photographs. Are you sure you have the correct muffler? It certainly looks the right one. I'll have another look at my setup and see if I can take any measurements that might help.

Jim,
I just looked at mine and the muffler is about 1/3 inch away from that bolt. Take the heat shield off of your pipe and then loosen the clamp that secures the Staintune to the header pipe. With that clamp loose grab the muffler and pull it away from that bolt. The Staintune will rotate slightly away from that bolt as you rotate it on the header pipe. If you get it straightened out that way great. If not, remove the Staintune and protect that mounting tab with cardboard while you bend it slightly with an adjustable wrench before remounting it. My first fix should work and it won't take you long. Cheers bro.

I spent about an hour today trying to get my Staintune to mount "correctly", but I still couldn't get the clearance others have. The bike's step bracket doesn't seem to be bent or improperly secured to the frame, so I can only imagine it's a manufacturing variance from Staintune. By loosening the mounting hardware and tugging it outward, along with reversing the washer/sleeve in the mounting point, I was able to get about a 2mm gap between the bolt & canister, which is fine with me as long as it stays that way. I'll be keeping a close eye on it in the coming weeks, but I'll save bending the mounting bracket as a last resort.
As you can see, there was definitely a bit of galvanic corrosion and abrasion going on:
